How the sale of property condition works

  1. You make an offer on your next home, conditional on selling your current home by a set date.
  2. The seller accepts, usually with an escape clause added.
  3. You sell your home before the deadline and remove the condition. The purchase becomes firm.
  4. If your home does not sell in time, the agreement ends and your deposit is returned, as set out in the agreement.

Two dates matter most: the deadline to sell your home and the closing date on your purchase. Leave enough time between them for your own buyer’s conditions to be removed and for your lawyer to coordinate both closings on the same day if possible.

The condition is written into Schedule A of the Agreement of Purchase and Sale. The exact wording matters, so have your agent and real estate lawyer review it.
